Insubordination: Legal Definition
Insubordination is a broad military offense. Under Article 91 of the Uniform Code of Military Justice (UCMJ), a warrant officer or enlisted member can be charged with insubordination if he or she:
- Strikes or assaults a warrant officer, noncommissioned officer (NCO) or petty officer while that officer is performing his official duties;
- Willfully disobeys the lawful order of a warrant officer, noncommissioned officer or petty officer; or
- Treats with contempt or is disrespectful in language or deportment toward a warrant officer, noncommissioned officer or petty officer while that officer is performing his official duties
In order to be convicted of insubordination, a defendant must have known that the person he or she struck, assaulted, willfully disobeyed or treated with contempt was a warrant, noncommissioned or petty officer.
